Cyberattack retaliation against ObamaCare attorney ongoing

Entire section of David Rivkin’s website destroyed

The coordinated cyberattack against prominent conservative lawyer David Rivkin, who recently led 26 state plaintiffs to a successful ruling against ObamaCare in Florida, destroyed a whole section of original articles and commentary from the lawyer’s website.

Administrators running the site, David Rivkin.com, released further information that the attacks which began Feb. 8 remain “ongoing” and have originated from multiple IP addresses in foreign countries, a common masking tactic used by hackers.

The crime is being reported to the Cyber Crime division of the FBI and possibly a higher level, according to sources connected to the site.

The Denial of Service (DoS) attack occurred just a week after a Florida federal judge found that ObamaCare was unconstitutional and should be thrown out, ruling in favor of plaintiffs that include 26 states, the National Federation of Independent Business and two individuals, all represented by Rivkin.

A former White House lawyer, Rivkin was the earliest legal voice to question the constitutionality of ObamaCare. He framed the debate from the beginning through editorials he wrote in 2010 with legal partner Lee Casey for The Wall Street Journal as well as numerous television appearances.

According to the most recent FBI statistics, sophisticated cybercrime is experiencing a major upswing, with the Internet Crime Complaint Center recording a 22 percent increase in attacks in 2009. There are also more attacks of a political nature as evidenced during the major Wikileaks story as well as the conservative group, Freedom Works, being hit by a hacker in 2010 just as it launched a fundraising effort and the losses were estimated at $80,000.

On the heels of a major federal court victory in the ObamaCare reform battle, lead outside counsel David Rivkin has become the victim of a cyberattack against his website.

Administrators running the site, David Rivkin.com, said they first became aware of significant problems on February 8. Around midnight on Thursday, Feb. 10, a million comments appeared within a five-minute time frame, destroying countless articles and interviews posted on Rivkin’s site.

“We are notifying the appropriate authorities and are confident the person responsible will be caught,” said Rivkin.

No “thrill” expected over judge’s ObamaCare ruling

Lead attorney for the 26-state ObamaCare lawsuit, David Rivkin of Washington, DC law firm Baker Hostetler, will appear on MSNBC’s Hardball with Chris Matthews tonight at 5 p.m. EST.

Host Matthews is well known for liberal positions on national issues and is expected to critique the Florida ruling that threw out the national health care law just repealed by the House.

Rivkin, a former White House lawyer who presented the individual mandate argument before Federal Judge Roger Vinson, will discuss the January 31 ruling that found ObamaCare to be unconstitutional.

The left-leaning Matthews, who famously felt “a thrill going up his leg” while listening to a speech by then-presidential candidate Barack Obama, probably will not feel a similar thrill as Rivkin discusses the states’ major victory.

Who defends the Supreme Court? The answer: A lawyer who knows the Constitution.

Lawyer David Rivkin went on the defense today in The Wall Street Journal, protecting the citizen rights of Supreme Court Justices “to participate in the greater society on which their decisions often have a profound impact.”

Rivkin’s timely defense comes on the day of the president’s State of the Union speech, an increasingly partisan pep rally which generated headlines last year when Justice Ailito shook his head in disagreement to the president’s claims that the Citizens United v. Federal Election Commission (2010) case, in which the highest court ruled “limits on corporate spending unconnected to any candidate’s campaign were unconstitutional,” was bad for America.

The court has not announced which justices are appearing, but Ailito was scheduled to speak at the law school at the University of Hawaii, and Scalia and Thomas rarely attend. That leaves Chief Justice Roberts, as well as Justices Kennedy, Ginsburg, Breyer, Sotomayor and Kagan to attend. Attendance by justices varies by year, but this year we are likely to see mostly Democrat-appointed justices before the Democrat president.

Rivkin and Lee Casey’s piece, “Common Cause v. Scalia and Thomas,” specifically condemns the liberal lobbying group, Common Cause, which has called for an investigation regarding Thomas and Scalia for alleged ethical lapses for attending “invitation-only” programs held by the Koch Family, owners of Koch Industries, which supports free market and libertarian causes.

Rivkin debunks the group’s claims, noting that the justices were guests of The Federalist Society (which sponsors public debate) and appeared only to speak at a dinner and did not attend the conference. He accuses Common Cause of attempting to “intimidate conservative judges, academics and activists” as well as overturn the Citizens United case.

Scalia's recent appearance at a meeting organized by the House Tea Party caucus and Rep. Michele Bachmann (R-Minn.) has also provoked liberals who see the high court as becoming more openly biased.

Who can blame any justice for not attending SOTU with the media and liberal lobbying groups targeting them with uninformed smear campaigns?
